Exclusions

The complete list of exclusions is available in the Terms & Conditions. Exclusions include but are not limited to:

  • For the Motor Third Party Liability (MTPL): bodily injury to the driver liable for the accident and damage to the insured vehicle.
  • For Material Damages: damage resulting from lack of vehicle maintenance, damage to objects carried by or equipment detached from the vehicle.
  • For Theft: theft committed with a lost key or one left in the vehicle and theft committed by the family or staff of the policyholder or insured person.
  • For Assistance: services that were not arranged by us or were done without our consent.
  • In all guarantees except MTPL and Assistance: damage resulting from an intentional act of the insured, gross negligence of the insured (such as drunkenness), a speed or skill contest, a nuclear risk, the failure of the vehicle to comply with the technical inspection regulations.
  • Professional drivers such as taxi driver, VTCs drivers (UBER, Cabify or equivalent) and any professional driving or transport of persons.
  • The vehicles that are registered under a diplomatic plate given by the Spanish Secretary of Foreign Affairs in accordance to the Directorate General for Traffic (DGT) rules in Spain will not be insured under this policy and any change in the vehicle plate on this sense must be declared by the policyholder immediately, as it will imply the end of the coverage policy when possible.

What is Motor Third Party Liability?

Motor Third Party Liability is a mandatory coverage for motor vehicles.
We cover the bodily injuries and/or property damage caused to third parties in the event of an accident caused by the insured vehicle.

What is Comprehensive Insurance (Omnium)?

Comprehensive Insurance covers material damage to the insured vehicle:

  • Fire & explosion
  • Theft
  • Glass breakage
  • Natural disasters
  • Collisions with animals
  • Material damage to the vehicle following an accident resulting from an impact, a fall, overturning or collision, as well as vandalism.

Can I cancel my insurance?

  • You can cancel your insurance after one year. You must notify Qover about this at least 2 months before the expiry date.
  • You may cancel your policy if we change the premium amount or the general terms and conditions.
  • You may cancel your policy up to one month after claiming compensation. The termination takes effect at the day after the date of the receipt or, in the case of a registered letter, from the day after it is submitted.
  • You may cancel your insurance within 14 calendar days of purchase or of receiving the contract.
  • You can cancel the contract in the event of assignment by the insurer of rights and obligations resulting from the policy. The termination must take place within three months after the assignment is communicated by the insurer to the policyholder.

The criteria

What are the criteria for determining acceptance?

For the underwriting of Motor Third Party Liability, the risk is accepted (or refused) on the basis of the following criteria or, if applicable, their combination:

  • The age of the policyholder, the main driver, the second driver or the usual driver.The use of this criterion is based on the statistical finding that age has an influence on the frequency and severity of accidents.
  • The country where the principal residence of the policyholder and/or the principal driver is located.
    The use of this criterion is based on the statistical observation that the administration of contracts and claims is more costly abroad.
  • The previous accident record of the policyholder, the main driver or the usual driver.
    The use of this criterion is based on the statistical observation that people with a high past claims record cause more accidents than people with a low past claims record.
  • The country of registration of the vehicle.
    For motor vehicles, the country of risk is the country where the vehicle is registered.
  • Withdrawal of driving licence, drunkenness, or alcohol intoxication of the policyholder or the main driver.
    The use of this criterion is based on the statistical observation that a person who has had his or her driving licence withdrawn and/or has been convicted or investigated for drunkenness or alcohol intoxication, refusal to take blood, hit-and-run or driving without a valid licence has a higher frequency of claims.
  • Specific measures relating to the quality of the risk taken by another company or by Helvetia Global Solutions Ltd.
    The use of this criterion is based on the statistical finding that a person who has been subject to specific risk quality measures (e.g. termination of liability coverage) by another company or by Helvetia Global Solutions Ltd has a higher claims frequency.
  • Legal and regulatory requirements.
    Both at the time of purchase and during the term of the contract, the driver and the vehicle must meet all legal and regulatory requirements for driving in areas where liability insurance is mandatory.
  • Commercial use of the vehicle for transporting passengers or commercial hire.

    No insurance cover is provided for vehicles used for commercial passenger transport (e.g. taxi, UBER) or commercial hire.
  • Diplomatic cars.

    The vehicles that are registered under a diplomatic plate given by the Spanish Secretary of Foreign Affairs in accordance to the Directorate General for Traffic (DGT) rules in Spain will not be insured under this policy and any change in the vehicle plate on this sense must be declared by the policyholder immediately, as it will imply the end of the coverage policy when possible.
What are the pricing criteria?

The rate applied to the subscription of the car liability insurance takes into account the following criteria:

  • The geographical area based on the address of the policyholder's main residence.
    The use of this criterion results from the statistical observation that inhabitants of certain geographical areas have fewer accidents at fault than inhabitants of other geographical areas.
  • The type of vehicle.
    The vehicle must be a Tesla Model 3, Model S, Model X or Model Y.
  • The age of the policyholder, the main driver, the second driver or the usual driver.The use of this criterion is based on the statistical observation that age has an influence on the frequency and severity of accidents.
  • Number of kilometers per year.
    Vehicles that travel a lot of kilometers per year spend more time on the road and therefore statistically have a higher risk of an accident. The number of kilometers per year influences the premium.
  • The previous accident record of the policyholder, the main driver or the usual driver.
    The use of this criterion is based on the statistical observation that people with a high past claims record cause more accidents than people with a low past claims record.
What are the criteria for determining the scope of the guarantee?

The age of the vehicle at the time of subscription influences the following guarantees:

  • Battery cover

When the insured motor vehicle is less than 2 years old starting from the date of first registration of the vehicle on the road, the High Voltage battery will be replaced with a new High Voltage battery of the same size. When a replacement is required and the insured motor vehicle is more than 2 years old starting from the date of first registration of the vehicle on the road, the insurer reserves the right to replace the damaged battery with a High Voltage battery of the same size that has been refurbished by Tesla or a third party authorized by Tesla.

If a reimbursement is requested instead of a replacement, the insurer will take possession of the damaged High Voltage battery and the reimbursement shall be calculated on the basis of the value of a refurbished High Voltage battery by Tesla at the time of occurrence and of the same size as the insured motor vehicle was originally delivered with.

  • Compensation at replacement value

If the Plan selected by the Policyholder and mentioned in the Special Conditions is the "Essential" Plan:

In the event of a total loss, you will receive the actual value of the insured motor vehicle.

If the Plan selected by the Policyholder and mentioned in the Special Conditions is the "Preferred" Plan:

In the case of a second-hand vehicle, i.e. where the Policyholder is not the first owner of the vehicle, or where the vehicle would have been insured elsewhere before this insurance policy was taken out, compensation at replacement value shall only be acquired for the remaining period between the date of first registration and the end of the period of 1 year from that first registration.

If the vehicle is more than 1 year old, compensation will be paid in accordance with the provisions from the second year onwards, i.e. the compensation will be calculated on the basis of the actual value of the insured motor vehicle.

If the Plan selected by the Policyholder and mentioned in the Special Conditions is the "Complete" Plan:

In the case of a second-hand vehicle, i.e. where the Policyholder is not the first owner of the vehicle, or where the vehicle would have been insured elsewhere before this insurance policy was taken out, compensation at replacement value shall only be acquired for the remaining period between the date of first registration and the end of the period of 2 years from that first registration.

If the vehicle is more than 2 years old, compensation will be paid in accordance with the provisions from the third year onwards, i.e. the compensation will be calculated on the basis of the actual value of the insured motor vehicle.
